The petitioner is languishing in custody since 13.04.2015 in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code.
The informant being Police Officer received secret information that fake ATM cards are being kept in the house of Shashi Bhushan Singh when raid was laid, the petitioner was apprehended and from his possession three ATM cards in different name, out of them one ATM card of Oriental Bank of Commerce, one PAN card, two fake seal, one voter I.D. card in
Patna High Court Cr.Misc. No.27213 of 2015 (2) dt.31-07-2015 2/2 the name of Subida Devi, several passport size photographs of different persons, mobile and sim cards were recovered. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the recovery was made from the possession of the petitioner. Admittedly the recovery was made from the house of Shashi Bhushan Singh and the petitioner was simply a tenant in the said house. Moreover, the investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 163 of 2015.
