The accusation against petitioner is that he along with others took the informant's son on a vehicle and kept him in confinement for a long period.
The contention on behalf of the petitioner is that the sister of petitioner had filed criminal case against her in-laws much prior to filing of the present case and as a matter of fact, the informant of the present case happens to be in-laws of sister of the petitioner and the informant lodged this false case to take avenge with the petitioner and his entire family members. It would appear from perusal of the impugned order of
Patna High Court Cr.Misc. No.28030 of 2015 (2) dt.06-08-2015 2/2 learned Sessions Judge that the statement of victim has been recorded under section 164 of the Cr.P.C in which he vividly stated the story of his kidnapping but admittedly, he was left near his village by his kidnappers themselves.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S.Case No. 02 of 2014.
