Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 379, 354, 504, 506, 427 of the Indian Penal Code and section 302 of I.P.C.

As per the prosecution case, the altercation took place between the two communities in which both side sustained injuries. Case and counter case.

Learned counsel for the petitioner submits that specific allegation of assault is against co-accused Ajeet Mochi, Anand Mochi and ranjeet Mochi who assaulted the deceased on his head with lathi danda and iron rod due to which deceased sustained head injury and during course of the treatment died. The petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Jehanabad, in connection with Ghosi P.S. case no.237 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
