JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 30.03.2015 on the accusation that he withdrew amount from the account of the informant through her ATM card which was collected by him from the concerned bank.

The submission on behalf of the petitioner is that it is well known fact that ATM card is handed over to the account holder and as a matter of fact, the informant's husband had taken some loan from the petitioner and when petitioner mounted pressure upon the informant to return the loan amount, she lodged this false case at the behest of enemies of the petitioner. Considering the aforesaid facts and circumstances as

Dwivedi, Judicial Magistrate 1st Class, Begusarai in connection with Bhagwanpur P.S. Case No. 137 of 2014.
