JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-366, 376, 313, 120(B) of the Indian Penal Code. The petitioner is languishing in jail custody since 0103-2016 but according to prosecution case itself, the informant along with the petitioner, went to Nepal by her own sweet will and subsequently, solemnized her marriage and except the allegation of got causing miscarriage, there appears to be no any other accusation against the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.20974 of 2016 (2) dt.19-05-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sadar (Muffasil) P.S. Case No. 257 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate-I, Purnea.
