Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Muffasil (Lakhaura) P.S. Case No. 417 of 2021 registered for offence punishable under sections 341, 323, 354B, 506//34 of the Indian Penal Code.
As per allegation, the informant was returning after watching fair and she was consuming water at hand pump. Meanwhile, the present petitioners along with co-accused Pappu
Patna High Court CR. MISC. No.5838 of 2022(2) dt.24-08-2022 2/2 Yadav came there and caught her hold. When she raised hue and cry, petitioner no. 1 torn her sameej, due to which, she became half naked. Meanwhile her father came there and slapped petitioner no. 2.
The learned counsel for the petitioners has submitted that petitioners are innocent and have falsely been implicated in this case.
On the other hand, the learned APP has opposed the prayer for bail.
Considering the above-mentioned facts and circumstances, it is not a fit case for anticipatory bail. Accordingly, it is rejected.
The petitioners are directed to surrender before the court below and make a prayer for regular bail. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
