JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-12-2017 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Mr. Rajendra Prasad Singh, Sr. counsel appearing on behalf of the petitioner submits that respondents have considered the case of the petitioner for compassionate appointment and from Annexure-5, it appears that the District Programme Officer through his letter dated 4.2.2016 has written to the Executive Officer, Nagar Parishad, Farbishganj for grant of compassionate appointment but unfortunately the letter contained in Annexure-5

Patna High Court CWJC No.16023 of 2017 (2) dt.15-12-2017 2/2 has not been acted upon as yet.

Considering the objective of the compassionate appointment, the respondents are required to take decision at the earliest in order to provide financial assistance to the family of the deceased employee who died in harness.

Since the authorities have already recommended the case of the petitioner for appointment on compassionate ground way back on 4.2.2016 as appears from Annexure-5, the writ petition is disposed of with a direction to the respondent nos. 6 and 7 to take final decision if not already taken in the matter of compassionate appointment of the petitioner within a maximum period of three months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ application stands disposed of.
