JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 The petitioner apprehends his arrest in connection with Barhiya P.S.Case No. 120 of 2018 registered under Sections 366A and 120B of the Indian penal Code.

Allegation against the petitioner is of kidnapping minor daughter of the informant.

At the very outset, it is submitted by learned APP that in this case process under Section 82 Cr.P.C. has also been initiated.

Submission of learned counsel for the petitioner is that statement of girl has been recorded in this case who has not supported the prosecution case.

Having heard both sides and in view of the facts and circumstances, let petitioner surrenders within a period of six

No.4746 of 2019(3) dt.12-03-2019 2/2 weeks from the date of receipt of a copy of this order and makes prayer for regular bail, which shall be considered on the basis of material available on record specially the statement of girl recorded under Section 164 Cr.P.C. and if possible, dispose of the same without being prejudiced by this order on the same day.
