2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 380 of the Indian Penal Code to Section 411 of the Indian Penal Code was added later on.
3. As per F.I.R., co-accused Ishwar Mahto with the help of his associates committed theft in the shop of the informant.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and during course of investigation no incriminating material has been recovered from possession of the petitioner. There is no material on record to connect this petitioner with the alleged crime. Petitioner claims

5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Mufassil P. S. Case No. 87 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
