The petitioner, Supendra Yadav, seeks regular bail in Mahishi P.S. Case No.23 of 2014, registered under Sections 366(A)/34 of the Indian Penal Code corresponding to Sessions Trial No.2284 of 2014.

Sushil Kumar Yadav, the father of the victim Nilu Kumari, alleged that Rukesh Kumar @ Raushan Kumar and others kidnapped his minor daughter, Nilu Kumari, aged about 15 years. Supendra Yadav, father of Rukesh Kumar @ Raushan Kumar, helped his son in kidnapping the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is the father of Rukesh Kumar @ Raushan Kumar. There is no evidence to show that he played any role in

Patna High Court Cr.Misc. No.29142 of 2014 (5) dt.05-01-2015 2/2 kidnapping the victim Nilu Kumari. His son is still traceless. Petitioner is in jail since 26.02.2014.

Perused the record.

It appears that the informant is not an eye witness of the occurrence. He only suspected the hands of the petitioner, as he is the father of Rukesh Kumar @ Raushan Kumar, that he might have helped his son in kidnapping Nilu Kumari. Considering the facts and the nature of allegation made against the petitioner and the fact that the petitioner is in jail since 26.02.2014, his prayer for bail is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc A.D.J.-II, Saharsa, in connection with Mahishi P.S. Case No.23 of 2014 corresponding to Sessions Trial No.2284 of 2014.
