Petitioner seeks bail in a case registered under sections 272, 273 of the Indian Penal Code as well as section 47 of the Excise Act. 700 liters country made liquor are said to have been recovered from the shop of the petitioner for which petitioner is in jail custody since 14.3.2016.

Moreover, the aforesaid recovery has not been made in presence of the petitioner and petitioner does not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in Raxaul P.S. Case no. 243/2015.
