The petitioner seeks pre-arrest bail in connection with Excise Case No. 1464 of 2019, pending in the Court of the Additional Sessions Judge VII-cum-Special Judge, Excise, Aurangabad, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

On receiving secret information about carrying the liquor for sale loading on vehicle by the petitioner in village Dano Bigha, the informant and other excise official reached there. On seeing the excise officials while the petitioner (Ravi Kumar) succeeded to flee away. On search of Maruti Wagon R, bearing registration no. DL-8CK-2490, 775 bottles, each

Submission is that in fact, the petitioner was the owner of the seized vehicle in which 775 bottles, each containing 300 ml Indian made foreign liquor are said to be recovered, but, the same vehicle is sold prior to this occurrence to Santan Kumar, son of Bind Singh, resident of village & P.S. Amba, Aurangabad, as such, the petitioner had no knowledge about carrying the liquor by Santan Kumar loading on the vehicle.

Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
