Petitioner seeks bail in a case registered under section 366A/34 of the Indian Penal Code.
According to the first information report the informant's daughters Minaka Kumari and Reena Kumari had gone in the eastern Sareh to attend the call of nature. While they were returning, the victim Reena Kumar aged about 17 years was forcibly taken away by the co-accused, Riku Ram (Ripu Ram) and his associates, Anil Ram and Rajdeo Ram. All the three accused persons made the victim to sit over their motorcycle and took her away.
On behalf of the petitioner it is submitted that
Patna High Court Cr.Misc. No.29387 of 2015 (2) dt.05-08-2015 2/2 petitioner is in custody since 02.05.2015and he has got no criminal antecedent. The victim in her statement recorded under section 164 Cr.P.C. has not named the petitioner.
On behalf of the State it is submitted that petitioner is named in the first information report. Considering the aforesaid facts, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial magistrate, Bettiah, West Champaran in Yogapatti P.S.
