JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 302, 120(B)/34 of the Indian Penal Code, under Section-27 of the Arms Act and Sections-10(29(i), 14, 16, 18, 20UA PA Act.

Petitioner is not named in the first information report and the impugned order of learned Additional Sessions Judge goes to show that in course of investigation, witnesses also did not disclose the name of the petitioner.

Submission on behalf of petitioner is that petitioner was arrested in a case of Arms Act and after that, police made the petitioner accused in the present case also. It is further submitted

Patna High Court Cr.Misc. No.19184 of 2016 (2) dt.05-05-2016 2/2 that petitioner is languishing in jail custody since 04-12-2015 in connection with the present case.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hilsa P.S. Case No. 646 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda.
