The petitioner is accused in connection with Mashrakh P.S. Case No. 84 of 2016, registered under Section 413 and 414 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R that one Vinay Kumar was apprehended by the Police, who disclosed about committing the theft of the motorcycle and selling of the same to the different persons including the petitioner and one Uday Bahadur Ray. Thereafter, the Police recovered the stolen motorcycle. Further submission is that, in fact, the petitioner is a student and has got no criminal antecedent purchased the motorcycle from co-accused Vinay Kumar without knowing the
Patna High Court Cr.Misc. No.19657 of 2016 (2) dt.11-05-2016 2/2 fact that the said motorcycle was stolen property. Further submission is that similarly situated co-accused, Uday Bahadur Ray has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 09.05.2016 passed in Criminal Misc. 20104 of 2016. The petitioner is in custody since 12.03.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, 8th, Saran, Chapra in connection with Mashrakh P.S. Case No. 84 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
