JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 This is an application for grant of anticipatory bail in connection with Itarhi P.S. Case No. 253 of 2018, disclosing offences under Section 379 of the Indian Penal Code. Allegation against the petitioners is of theft of the truck of the informant.

Submission of learned counsel for the petitioners is that as a matter of fact the husband of the informant had purchased the truck from the petitioners in Rs.5,25,000/- and only Rs.2,00,000/- was given and Rs.3,25,000/- was due, which will appear from Annexure-2 and in order to save themselves from the dues, the present case has been lodged. Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.6487 of 2019(3) dt.02-04-2019 2/2 submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Itarhi P.S.
