JUSTICE BIRENDRA KUMAR ORAL ORDER 07-02-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a)of the Bihar Prohibition and Excise Act, 2016. Though name of the petitioner has surfaced in the confessional statement of co-accused, from whose possession, recovery of liquor is there. However, the petitioner has got identical criminal antecedent as disclosed in paragraph-3 of the bail petition, hence, I am not inclined to enlarge the petitioner on anticipatory bail.

Accordingly, prayer is refused in connection with P.R. Case No.110 of 2018, Misc. Excise Case No.909 of

Patna High Court Cr.Misc. No.7296 of 2019(2) dt.07-02-2019 2/2 2018 pending in the court of learned Addl. Sessions Judge-2nd -cum-Special Judge, Excise, Supaul.

In the event of surrender of the petitioner, prayer for regular bail shall be considered without being prejudiced by this order.
