JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 731 of 2017, Trial No.4027 of 2018 disclosing offences under Section 498(A) of the Indian Penal Code and Section 3⁄4 of the D.P. Act. Allegation against the petitioner is of demanding Rs.1,00,000/- from the complainant and later on, ousted her from his house and the petitioner has remarried with the another lady.

Submission of learned counsel for the petitioner is that marriage was solemnized eight years ago and he is still ready to keep her and the allegation of second marriage is false and concocted and the cognizance has been taken under Section

Patna High Court CR. MISC. No.6521 of 2019(3) dt.02-04-2019 2/2 498(A) of the Indian Penal Code.

Heard learned A.P.P. as well as learned counsel for the complainant, they have opposed the prayer for anticipatory bail of the petitioner stating that he has remarried with the accused no.4 of the complaint petition.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., West Muzaffarpur, in connection with Complaint Case No. 731 of 2017, Trial No.4027 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that the petitioner shall cooperate in the trial.
