Mr.Md. Matloob Rab ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Sheosagar P.S. Case No. 247 of 2018 registered for offence punishable under sections 341, 324, 326, 504, 506, 307, 379 and 325/34 of the Indian Penal Code. Allegation has been made that all the accused persons surrounded and gave knife blow to the informant. The learned counsel for the petitioners submits that there is specific allegation against Munna Ram, who has already

Patna High Court Cr.Misc. No.3195 of 2019(2) dt.25-01-2019 2/3 been allowed regular bail by one of the coordinate Bench of this Court in Cr. Misc. No. 65566 of 2018.

Looking to the entire facts and circumstance of the case, the prayer for bail of Dularo Devi (petitioner no. 7) is allowed and she, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/-each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sheosagar P.S. Case No. 247 of 2018, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court The petitioners will not induce any witness or tamper with the evidence.

The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. Whenever the police will call the petitioner no. 7 for the purpose of investigation during interrogation in the aforesaid case, she will present herself. In case of failure, the prosecution will have liberty to file an application for cancellation of her bail before the court below.

However, if they surrenders and prays for regular bail, the court below after considering the materials on record and also taking into consideration that Munna Ram in whose favour the regular bail has been granted by one of the coordinate Bench of this Court, will take decision and pass the order in accordance with law.
