The petitioner is accused in connection with Runisaidpur P.S. Case No. 153 of 2011, registered under Sections 302/34 of the Indian Penal Code, Section 27 of the Arms Act, Section 17 of C.L.A. Act and Section 10,13, of U.A.P. Act.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation after 21 months, Police got recorded the statement of the three witnesses as detailed in para 73, 74 and 75 of the case diary to the effect that this petitioner was also present having pistol in his hand at the place of occurrence. Further submission is that, in fact, petitioner is accused in six other cases, out of which he has
Patna High Court Cr.Misc. No.19990 of 2016 (3) dt.15-07-2016 2/2 been acquitted in four cases and in two cases he is on bail due to that reason Police got implicated the petitioner in the present case after 21 month of the occurrence. The petitioner is in custody since 12.12.2013.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge, Sitamarhi in connection with Runnisaidpur P.S. Case No. 153 of 2011. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
