JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-353, 307 & other minor sections of the Indian Penal Code.
The claim of the informant is that some lands were acquired for construction of railway line and when the informant and other officials went there in connection with construction work, petitioners and several other accused made obstruction and assaulted the informant as well as other officials. Submission on behalf of petitioners is that the lands,
Patna High Court Cr.Misc. No.20898 of 2016 (2) dt.19-05-2016 2/2 in question, were acquired but no compensation was paid and a writ petition was filed, which was pending at the time of alleged occurrence but later on, it was disposed off and even then, the government officials, forcibly, wanted to take possession of aforesaid lands.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bhagwanpur P.S. Case No. 43 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan. (Hemant Kumar Srivastava, J) A.K.V./- U T
