Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Gopalganj PS case no. 963 of 2023 instituted for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that on 04.12.2023, the informant got information that co-accused Prabhawati Devi along with four persons were demolishing the pillar of the door of the informant. When the informant arrived at the place of occurrence and protested, the petitioner assaulted him by iron rod, due to which, he sustained

Learned counsel for the petitioner submits that there is land dispute between the parties and a counter case has also been lodged by the side of the petitioner against the informant and others bearing Gopalganj PS Case No. 962 of 2023. Learned counsel further submits that 12 dhurs of land was sold by the petitioner in favour of the informant but the informant started making construction upon the land which was already sold. He next submits that injury caused to the informant is simple in nature except the injury on non-vital part of the body i.e. his left leg.

On the other learned counsel for the State opposed the prayer for bail and submits that there is specific allegation of assault against the petitioner, due to which, the informant sustained grievous injury on his leg i.e. fracture of his leg and he underwent surgery of his leg.

Having regard to the submissions made by learned counsel for the parties and taking into consideration the fact that there is land dispute between the parties, petitioner remained in custody since 23.09.2024 and charge-sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XV, Gopalganj, in connection with Gopalganj PS case no. 963 of 2023.
