JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One levy receipt of communist party, two mobiles, some cash and identity cards of members of Maoist group are said to have been recovered from the house of the petitioner when the police raided his house. The accusation against the petitioner is that he had arranged a meeting of nexalites and was indulged in collecting levy from different persons. Petitioner carries criminal antecedent of altogether six cases but submission on behalf of the petitioner is that out of the aforesaid six cases, petitioner has already been granted privilege of bail in four cases and so far as present case is concerned, no incriminating article appears to have been recovered from the house of the petitioner and so far as

Patna High Court Cr.Misc. No.19991 of 2016 (2) dt.06-05-2016 2/2 recovery of levy receipt is concerned, it is only highhandedness of the police.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Sitamarhi in connection with Runnisaidpur P.S.Case No. 286 of 2012/Sessions Trial No.62 of 2013.
