The petitioner seeks regular bail in connection with Agiaon Bazar PS case no. 05 of 2018 registered for the offence punishable under Section 395 of Indian Penal Code. The allegation is regarding unknown miscreants having entered the house of the informant and looted various articles.

The learned counsel for the petitioner submits that as far as the petitioner is concerned, he is innocent inasmuch as neither any recovery has been made from his conscious possession nor there is any evidence to connect the petitioner with the alleged incident. The petitioner is stated to be accused in two other cases but he is on bail in the said cases. It

Patna High Court Cr.Misc. No.5687 of 2019(2) dt.01-02-2019 2/2 is further submitted that the petitioner is languishing in custody since 27.10.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Bhojpur at Ara in connection with Agiaon Bazar PS case no. 05 of 2018.
