JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 356/379/34 of the Indian Penal Code.

As per the prosecution case, two motorcycle borne miscreants tried to snatch mobile phone from a person. However, on chase by people, one of them was caught, while his accomplice managed to escape. In the meantime, police came and apprehended him. He disclosed that he was driving the motorcycle while this petitioner was pillion rider who escaped. Learned counsel appearing for the petitioner submits that the petitioner's name has figured during course of investigation in confessional statement of co-accused. No incriminating material has been recovered from the possession

Learned counsel for the State opposes the prayer for bail. He submits that the petitioner has got criminal antecedent of similar nature.

Considering the nature and gravity of allegation as well as the fact that petitioner has got criminal antecedent of similar nature, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) shashi/- U T
