The petitioner seeks bail in anticipation of her arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that there was a document verification in the Education Department of appointed teachers. It is further alleged that the mark-sheet of the petitioner was investigated by the Secretary, Bihar School Examination Committee, Patna and thereafter, was found that there was difference in total marks. Thus, it is alleged that the petitioner got appointment by changing her total marks.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is next

Patna High Court CR. MISC. No.5228 of 2022(2) dt.18-08-2022 2/2 submitted that similarly situated co-accused Dinesh Prasad, Kiran Kumari and Basanti Kumari have been granted anticipatory bail by order dated 20.01.2021 in Cr. Misc. No.7602 of 2020. The learned counsel thus seeks parity.

The learned Additional Public Prosecutor opposes the anticipatory bail application, but is not able to meet the submission of the learned counsel for the petitioner that similarly situated coaccused have been granted anticipatory bail by this Court. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kochaikote P. S. Case No.365 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
