The petitioner seeks bail in connection with Danapur P.S. Case No. 482 of 2021 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.07.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 500 liters of liquor from an Auto. Learned counsel for the petitioner submits that the petitioner was a passenger and as such was not knowing who had kept the liquor in the Auto.

Patna High Court CR. MISC. No.5582 of 2022(2) dt.09-03-2022 2/2 Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 20.07.2021 is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Danapur P.S.
