The petitioner is accused in connection with Sherghati P.S. Case No.320/2015 registered under Sections 376, 511 and 506 of the Indian Penal Code.
The accusation is that in course of returning of the victim, the daughter of the informant after attending the call of nature in the way this petitioner forcibly took her near the bridge and started to caught hold to commit rape, in the meantime her father came and caught hold the petitioner. At that time, the brother of the petitioner and other family members came and started to scuffle to her father giving threatening to kill him. Learned counsel for the petitioner submits that in
Patna High Court Cr.Misc. No.19753 of 2016 (2) dt.12-05-2016 fact there was some land dispute between the family of the petitioner and informant and due to that reason, the petitioner has falsely been implicated in this case with false allegation of attempt of rape at her. Further submission is that the petitioner has no criminal antecedent and is in custody since 12.12.2015. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case No. 320/2015.
