NILU AGRAWAL ORAL ORDER 05-02-2019 Heard the learned counsel for the petitioner and the learned counsels appearing on behalf of the State as well as the Accountant General, Bihar, Patna.

The husband of the petitioner died while in harness on the post of Clerk in Block Office, Patepur on 21.12.2010. The petitioner being the wife of the erstwhile employee seeks payment of Family Pension, GPF, Leave Encashment, Gratuity, Group Insurance which is legally entitled to her being the legal heir of her late husband.

Considering the nature of claim as made in the writ

Patna High Court CWJC No.1529 of 2019(2) dt.05-02-2019 2/2 application, the petitioner is directed to file a fresh representation before the respondent no.3 the District Magistrate, Vaishali at Hajipur who would look into the claim of the petitioner and dispose of the same within a period of three months.

Any amount due to the petitioner would be paid within one month thereafter. If certain amounts are inadmissible, the same shall be communicated to the petitioner by a speaking order sent through registered post.

Writ application is disposed of accordingly.
