Petitioner is accused in connection with S. Tr. No. 95 of 2013/12 of 2014 arising out of Narhat P.S. Case No. 129 of 2010 registered under Sections 323, 341, 337, 338, 397 and 504/34 of the I.P.C. and later on, section 302 of the I.P.C. was added.
Earlier prayer of the petitioner for bail was rejected by this Court vide Cr. Misc. No. 13875 of 2013 on 24.03.2014 taking into consideration the nature of allegation against the petitioner and one Suresh Chaudhary, being assailant of the deceased causing injury by hard and blunt substance with direction to the Trial Court to expedite the trial. It is submitted that
Patna High Court Cr.Misc. No.30230 of 2015 (3) dt.26-08-2015 2/2 petitioner is in custody since 07.09.2012 and co-accused Suresh Chaudhary has already been allowed bail by this Court vide Cr. Misc. No. 20754 of 2015 on 06.05.2015.
The report as called for vide Letter No. 141 dated 01.08.2015 from the Court of Additional Sessions Judge-II, Nawada discloses that out of eight charge-sheet witnesses, only two witnesses have been examined and remaining witnesses are to yet be examined.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. IInd, Nawada in connection with S. Tr. No. 95 of 2013/12 of 2014 arising out of Narhat P.S. Case No. 129 of 2010. (Rajendra Kumar Mishra, J.) Shail/- U T
