Learned counsel for the petitioner submits that he may be allowed to withdraw this writ application with liberty to file an appropriate appeal before the District Teachers Employment Appellate Authority, Siwan within a period of 30 days from
Patna High Court CWJC No.1960 of 2023(2) dt.22-06-2023 2/2 today.
Learned counsel for the State has no objection to the same.
In the given circumstance, this writ application is permitted to be withdrawn with liberty to the petitioner to seek his remedy, if any, available to him before the District Teachers Employment Appellate Authority, Siwan by filing an appeal within a period of 30 days from today. If any such appeal is preferred, the same will be considered on it's own merit and the question of limitation, if any arising in the appeal, would be considered keeping in view the petitioner was pursuing his writ application in this Court under some bonafide belief.
