JUSTICE RAKESH KUMAR ORAL ORDER 05-04-2019 Heard Sri Manoj Kumar Manoj, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Lauria P.S. Case No. 147 of 2017 , registered for the offence under Section 272, 273, 420, 467, 468, 471, 120B, 414 of the Indian Penal Code 1860 and Section 30(a)/35(a) , 36, 38, 41 and 47 of the Bihar Prohibition And Excise Act 2016 has prayed for grant of bail in the event of his arrest or surrender.

It was submitted by learned counsel for the petitioner that petitioner being owner of the truck in question was not at all knowing regarding carrying of illegal liquor and without his knowledge the driver had used the vehicle. On aforesaid

Patna High Court CR. MISC. No.7862 of 2019(4) dt.05-04-2019 2/2 grounds a prayer has been made for granting anticipatory bail however, on going through the same the court is of opinion that instead of entertaining the prayer for anticipatory bail, this petition can be disposed of with observation that if within six weeks from today petitioner appears before the court below and prays for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.
