12-08-2015 Heard Sri Ram Prawesh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the second attempt for grant of bail. Earlier prayer for bail of the petitioner was rejected, mainly on the ground that period of custody was lesser.

In this case, earlier a report was called for from the court below, which has been received and kept at flag 'A'. The report indicates that trial has already commenced and the learned court has issued bailable warrant of arrest for securing attendance of witnesses.

In view of the facts and circumstances as well as observation given in earlier order, the Court is of the opinion that the petitioner can be extended the privilege of bail.

Patna High Court Cr.Misc. No.29330 of 2015 (4) dt.12-08-2015 2/2 Let the petitioner, namely; Rahul Kumar @ Rahul Nand Bharti be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Nawadah/concerned court in connection with Sessions Case No. 59 of 2015 (arising out of Hisua P.S. Case No. 81 of 2013) on condition that one of the bailor must be blood relation of the petitioner and on each and every date during trial, the petitioner shall remain physically present before the court below. If continuously on two dates, without prior permission of the trial court, the petitioner fails to appear, his bail-bond shall stand automatically cancelled.
