In this case, the petitioner is seeking bail in connection with Kotwali P.S. Case No. 719 of 2015 registered for offences under section 420 of the Indian Penal Code. An allegation has been made in the FIR that the petitioner has given an impression that he will double the money. He has taken Rs. 6,00,000/- from the Informant in the name of giving double amount but he did not return even the principal amount. Again Rs. 3,00,000/- was demanded from the Informant and assured to return Rs. 10,00,000/- but the Informant informed the police and the petitioner was arrested.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.18484 of 2016 (2) dt.05-05-2016 petitioner was in hotel room and from there itself, the petitioner was handed over to the police. He has also submitted that one of the co-accused, namely, Raju Kumar Singh @ Raju Kumar has been granted by this court by order dated 11.4.2016 in Cr. Misc. No. 14899 of 2016.
Looking to the facts and circumstances of the case, let the petitioner, namely, Abdul Slam @ Abdul Salam, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 719 of 2015, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below.
Patna High Court Cr.Misc. No.18484 of 2016 (2) dt.05-05-2016 cancelled.
