The petitioner seeks bail in a case registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code.

It is submitted that the petitioner is not named in the F.I.R. During investigation his name has appeared. It appears that the petitioner had purchased the mobile phone but the same was used by his brother. The petitioner is a student of Hotel Management at Shillong and on the basis of use of the mobile phone he has also been made accused in Ishuapur P. S. Case no. 145 of 2014, in which he has been granted bail after considering the fact. The petitioner is in custody since 4.5.2015. However, after investigation chargesheet has already been submitted and there is no chance of tampering with the witnesses.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.29524 of 2015 (2) dt.13-08-2015 2 / 2 amount each to the satisfaction of learned C.J.M., Saran at Chapra in Ishuapur P.S. Case No. 146 of 2014 with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
