The petitioner seeks bail in Maheshkhunt P.S. Case No. 87 of 2020, registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner in connivance with his wife and nephew defalcated Rs. 20 lakhs from petrol pump of the informant and purchased a truck in the name of his wife and nephew.

It is submitted on behalf of the petitioner that petitioner is staff and he has falsely been implicated in this case. Allegation of cheating of Rs. 20 lakhs is false and concocted. As a matter of fact, nephew of the petitioner has purchased a truck on loan of Rs. 22 lakhs in the year 2016 and the same was

On 15.05.2020 nephew of petitioner parked his truck at the petrol pump of informant for taking petrol/diesel then informant and his associates forcible took his truck and confined the petitioner and his nephew in his house for which complaint case No. 254-C of 2020 was lodged on 25.05.2020 and after knowing this fact in order to save his skin from the complaint case, present case has been lodged against petitioner and others. It is next submitted that Balance Sheet of the petrol pump which is at Annexure-3 shows that there is no defalcation or cheating of money with the informant or from his petrol pump. Petitioner claims clean antecedent and he is in custody since 04.10.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Khagaria in connection with Maheshkhunt P.S. Case No. 87 of 2020.
