This Court vide order dated 14.09.2016 directed the Dy. S.P., Barh to ensure the attendance of the prosecution witnesses in the trial court on the date fixed so that the trial must be concluded within six months. The order was received in the office of Dy. S.P., Barh and he in pursuance thereof directed the SHO, Bakhtiyarpur to ensure the attendance of the prosecution witnesses vide his letter dated 30.09.2015 but it appears that, of course, the Dy. S.P., Barh sent several letters directing the SHO, Bakhtiyarpur to ensure the attendance of the prosecution witnesses but even after lapse of one year the trial has not yet been concluded. Mr. P.N. Sahi, learned senior counsel has submitted that
Patna High Court Cr.Misc. No.21308 of 2016 (4) dt.22-09-2016 2/2 this is the first instance in which Shri Manoj Kumar Tiwary, the Dy. S.P., Barh has not partially obeyed the order of this Court. Considering the explanation offered by Shri Manoj Kumar Tiwary, the Dy. S.P., Barh the same is accepted with a warning that he must be cautious in future in ensuring the compliance of the order.
Shri Sahi submitted that the trial is likely to be concluded within one month. Accordingly, prayer for bail of the petitioner above named is rejected.
The trial court is directed to hold the trial and conclude the same within one month from today.
