Mrs. Anita Kumari Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-03-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 304 B, 201 & 34 of the Indian Penal Code.

Petitioners along with other accused persons are said to have mentally and physically tortured the daughter of the informant and lastly they set her ablaze on non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place.

The allegation levelled against the petitioners is not specific rather general and omnibus in nature. It is further submitted that the petitioners are poor and daily wager earners. They are living separately from the daughter of the informant and her husband. It is also submitted that the informant's daughter died naturally but due to ill motive and to extort money from the petitioners, this false and frivolous case has been lodged against them. Petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipur, Darbhanga in connection with Bahera P.S. Case No.386 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
