JUSTICE SUDHIR SINGH ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 354, 302 and 504/34 of the Indian Penal Code. Earlier bail application of the petitioner was rejected vide Annexure-1 to the present application with a direction to the trial court to conclude the trial within a period of nine months. A report was called for from the trial court. It has been reported that charge has not yet been framed in this case. The case has been committed to the court of sessions. The petitioner is in custody since 23.2.2015. From perusal of paras- 21, 22 and 23 of the case diary it is evident that the witnesses have denied present of the petitioner at the place of occurrence. In paras- 85, 86, 88 and 89 of the case diary the independent witnesses have stated that the deceased had died of illness.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions
