JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-02-2020 The petitioner in the present case is seeking quashing of the first information report giving rise to Patliputra P.S. Case No. 542 of 2019 registered under Section 365 of the Indian Penal Code.

It is the case of the petitioner that respondent no. 9 has lodged a false case against him and that she is pressurizing the petitioner to marry his daughter.

Perusal of the first information report as contained in Annexure '1' shows that there is an allegation that this petitioner

Patna High Court CR. WJC No.188 of 2020(2) dt.18-02-2020 2/2 has taken away the daughter of the informant after giving her a call on her mobile number stated in the FIR.

The case has been registered only on 24.11.2019 and at this stage sitting in its writ jurisdiction, this Court would not take upon itself to record a finding on the basis of the submission of the petitioner.

Learned counsel for the State has submitted that the matter is still under investigation and it is open for the petitioner to bring all such materials which are available to him to the notice of the investigating officer.

The submission made on behalf of the State is a reasonable submission and this Court is also of the considered opinion at this stage that in case the petitioner wants to bring any material to the notice of the Investigating Officer, he is free to participate in course of investigation and assist the Investigating Officer in reaching to a proper conclusion.
