JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-09-2021 Heard Mr. Birendra Narayan Sharma, learned counsel for the petitioner and Mr. Nitya Nand Tiwary, learned Additional Public Prosecutor, appearing for the State.
Learned counsel for the petitioner submits that by order dated 28.08.2019, the time granted by this Court to the petitioner to surrender before the Court below for furnishing bail bond be extended by further two weeks.
Learned counsel for the petitioner further submits that petitioner had fallen ill and after diagnosis, doctor found him suffering from infective Hapatitis, as such, the petitioner could not appear and surrender before the Court below within time, as
Patna High Court CR. MISC. No.11438 of 2021(2) dt.22-09-2021 2/2 per the order dated 28.08.2019 passed by this Court. Regard being had to the submissions made by learned counsel for the petitioner, the order dated 28.08.2019 is modified to the extent that the time granted by this Court earlier, is extended by further two weeks from today, to enable the petitioner to furnish bail bond in the Court below. This application is accordingly allowed.
