The petitioner has sought for issuance of a command against the respondents to make payment of arrears of pension after enhancement of grade pay to Rs.4,800/- in the pay-scale and pay-scale from Rs.6,500/- to Rs.10,500/- in pursuance of the Govt. Letter dated 04.10.2010. Further prayer is for payment of revised gratuity in pursuance of letter dated 23.09.2009. The petitioner joined the service on 05.01.1981 and retired on 31.12.2009 from the post of Agriculture Extension Officer.

Patna High Court CWJC No.1569 of 2019 dt.21-01-2021 2/2 The respondents in their counter affidavit stated that the entire grievance of the petitioner has already been redressed as claimed grade pay as well as pay-scale was taken into consideration by the respondent-authorities in deciding the quantum of pension which was revised, later on, after pay revision. Likewise, gratuity has also been calculated according to the formula detailed in paragraph 10, 11 and 12 of the supplementary counter affidavit. Therefore, the respondents have nothing to do further in this matter.

Learned counsel for the petitioner claims for interest on the delayed payment.

However, the record would reveal that cheques for payment were ready in favour of the petitioner but the petitioner refused to receive the same due to pendency of this writ application.

Since grievance of the petitioner has already been redressed, this writ application stands disposed of. (Birendra Kumar, J) Kundan/- AFR/NAFR N.A.
