The petitioners are apprehending arrest in a case registered for the offences punishable under sections 379/461 of the Indian Penal Code.
Prosecution case is that from the foreign liquor shop of the informant Rs.1,32,000/- was found missing, leading to registration of FIR against the petitioners since the key of the shop used to remain with them as they were employee of the shop, in question.
It is submitted by learned counsel for the petitioners that since consumption of sale of liquor was prohibited by the government, hence, the informant in order to misappropriate the wages of the petitioners has lodged the present case. There is no
Patna High Court Cr.Misc. No.22702 of 2016 (2) dt.20-05-2016 2/2 recovery from the petitioners. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Masaurhi P.S. Case No.474/2015, pending before the learned SDJM, Masaurhi, Patna.
With the above observation, this application is, accordingly, disposed off.
