JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Narayanpur P.S. Case No. 67 of 2015, registered under Sections 304(B), 201/34 of the Indian Penal Code.

The prosecution case is that the marriage of Priyanka Devi was performed in the month of April, 2015 with Arjun Sah but she was not taken in Bidai due to non-fulfillment of demand of motorcycle and golden chain. On 02.10.2015, his son-in-law came at the house of informant and accompanied his daughter Priyanka Devi on the pretext to get a photograph, but his daughter did not return in the night. When he tried to talk on mobile, then she was started weeping on mobile. Thereafter, informant went to her matrimonial house for search, but no trace

Patna High Court Cr.Misc. No.19624 of 2016 (2) dt.10-05-2016 2/2 was found. On 05.10.2015, he received information about recovery of dead body by the Police. Thereafter, he rushed there and identified the dead body of his daughter Priyanka Devi. Learned counsel for the petitioner submits that petitioner is brother of the husband of the deceased and he has been falsely implicated. It would appear to F.I.R. that it was the Arjun Sah, husband of Priyanka, who taken her from her myaka and thereafter her dead body was recovered. The petitioner having no criminal antecedent is in custody since 05.01.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arrah in connection with Narayanpur P.S. Case No. 67 of 2015.
