The petitioner is accused in connection with Kudhani P.S. Case No. 64 of 2016 registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act.
The accusation is that police, on receiving secret information about gathering of miscreants for preparation of committing dacoity, reached at Chandrahati, where two motorcycles were found standing condition and five persons were talking to each other but on seeing the police they started to flee away. On chased, Niraj Kumar, Suraj Kumar and Ravi Kumar were apprehended, who disclosed the name of their associates

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to ulterior motive whereas his name has been surfaced on the basis of confessional statement of co-accused except that there is nothing against him. Further submission is that petitioner is in custody since 25.02.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Muzaffarpur, in connection with Kudhani P.S. Case No. 64 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
