Mr.Parmeshwar Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-08-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged against the petitioner that during raid by the informant being District Agriculture Officer, Araria, the cash memos issued to the farmers and stock register was not found properly maintained by the petitioner being proprietor of M/s Yusuf Khad Beej Bhandar.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in

Patna High Court CR. MISC. No.6009 of 2022(2) dt.03-08-2022 2/2 this case. It is further submitted that the petitioner has dully submitted his show-cause explaining his charges. The posh machine was not functional as printing paper was not available in the Palasi market and no sooner the same was made available, receipts were issued to the farmers.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 153 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
