The present application has been preferred: for issuance of a writ/writs, order/orders, direction/directions to the respondents not to disturb the possession of the petitioners over the land bearing Khata No. 120, survey Plot Nos. 858, 859, 860 and 861 situated in Mouja Pokhara, Police Station Maharajganj, District Siwan and interdict them from making any construction over the land for the proposed road or for any other purpose because the abovementioned land has been

Patna High Court CWJC No.9295 of 2017(2) dt.28-04-2025 2/2 purchased by the Petitioner No. 1 through sale deed on 5.7.1951 and since then the land is in peaceful possession of the petitioners and without giving any notice or without starting any proceeding the Respondent Nos. 3 and 4 tried to construct the road on the plot and further direct the Respondent No. 1 to examine the complaint filed by the petitioners and pass appropriate order on the petition of the petitioner and direct the Respondent No. 4 and 5 not to make any construction on road on the plot of the petitioners and further for necessary other and direct the Respondent No. 4 and 5 not to make any construction of road on the plot of the petitioners and further grant any other relief/reliefs as the petitioners are found entitled to in the facts and circumstances of the case.

3. After some argument, learned counsel for the petitioner submits that liberty be granted to approach appropriate forum for the redressal of the grievance.
