This application, for grant of anticipatory bail, arises out of Turkaulia Police Station Case No. 179 of 2018, disclosing offence under Section 366A of the Indian Penal Code. Considering the statement of the informant's daughter, recorded under Section 164 of the Code of Criminal Procedure, 1973, to the effect that she and the petitioner have solemnized marriage and she had left her house out of her own volition, this application is allowed.

Let the petitioner, Milan Kumar @ Milan Kumar Sah @ Milan Kumar Soni, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.5499 of 2019(2) dt.31-01-2019 2/2 before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkaulia Police Station Case No. 179 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
