NILU AGRAWAL ORAL ORDER 11-02-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the State. Petitioner is in languishing in judicial custody since 08.11.2018 in connection with K.Hat P.S.Case No.760 of 2018 for the offence alleged under Sections 363 and 366(A)/34 of the Indian Penal Code.

The prosecution case as lodged by the informant is that his daughter aged about 15-16 years has been kidnapped by co-accused Md. Gholu Ansari and the petitioner. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and the victim girl had run away with another co-accused Md. Gholu Ansari and has solemnized marriage with the said co-

He further submits that there is no allegation against the petitioner of kidnapping the minor daughter of the informant and only the petitioner has been named in the FIR. He further undertakes not to induce witnesses or tamper with the prosecution and cooperate in the trial.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with K.Hat P.S.Case No.760 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Purnea subject to the condition that one of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating their relationship with the petitioner.
