The petitioners apprehend their arrest in Kudhni (Turki O.P.) P.S. case No. 451/2019 registered under Section 30(a), 38(i)/41(i) of the Bihar Prohibition & Excise Act. The police raided the house and Khalihan of Umesh Rai after receiving secret information about the storage of illicit Indian made foreign liquor and recovered 383.760 liters of liquor from the Darwaja of Umesh Rai but in the later part of the FIR the informant inserted the names of the petitioners alleging therein that the petitioners had also invested money in the trade of illicit liquor.

No.6863 of 2020(2) dt.12-06-2020 2/2 It appears that nothing has been recovered from the possession of the petitioners and there is no material collected by the I.O. during the course of investigation that petitioners invested money in the purchase of liquor kept by Umesh Rai in his Darwaja.
Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Kudhni (Turki O.P.) P.S. case No. 451/2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
